EASA introduces regulatory framework for the operation of drones

In May 2017 EASA has published a Notice of Proposed Amendment (NPA), introducing a new regulatory framework for the operation of drones.

In accordance with Regulation (EC) No 216/2008 the regulation of UAS with a MOTM of less than 150 kg falls within the competence of the Member States, which led to a fragmented regulatory framework across the EU. In order to ensure a single market and cross-border UAS operation a new so-called Basic Regulation is being discussed between the Council and the European Commission aiming to extend the EU competence to regulate UAS regardless of their MTOM.

Implementing a combination of limitations, operational rules and requirements for the competence of the remote pilot, as well as technical requirements for the UAS, the new Regulation constructs a framework concerning safety and security as well as data protection and environmental issues. Yet the Regulation shall provide flexibility to the Member States, allowing them to create zones, where operations would be prohibited, limited or facilitated.

The NPA is open to public consultation, starting from 12 May 2017 until 12 August 2017. Comments can be submitted using the automated Comment-Response Tool downloadable here.
