Berlin Space Protocol adopted!
On 9 March 2012 the „Protocol to the Convention on International Interests in Mobile Equipment on Matters specific to Space Assets“ (in short “Space Protocol”) was adopted by the Diplomatic Conference which took place in Berlin from 27 February to 9 March 2012. The Space Protocol constitutes the third protocol to the Convention on International Interests in Mobile Equipment adopted 2001 in Cape Town (the “Cape Town Convention”). The Space Protocol introduces the first international instrument for asset based financing specific to space assets. Owing to the specificities of space based security objects the negotiations preceding the adoption of the Space Protocol were especially complex. In five meetings of governmental experts since 2008, also the industry, including established satellite operators were given the opportunity to participate in the improvement of the text. The Diplomatic Conference again povided an important platform, once more inviting also the industry to submit their suggestions in finalization of the draft Space Protocol. With the adoption of the text developing and industrialized countries alike have now expressed their unwavering believe in the success of the Space Protocol to the future developments of space activities. As continuous participant and technical advisor in the negotiations since 2008 BHO Legal would like to congratulate UNIDROIT and its Member States, in particular the Government of the Federal Republic of Germany as host of the diplomatic conference to the successful adoption of the Space Protocol.
